Illinois Agency Wins Over Waste Dumping

The Supreme Court rules that the Clean Water Act does authorize the government to regulate dumping of solid waste into isolated ponds and wetlands.

"By a vote of 5 to 4, the court held that the Clean Water Act did not empower the Army Corps of Engineers to stop a suburban Chicago solid waste agency from building a landfill on the site of a former gravel mine studded with shallow, rain-filled ponds thatform a habitat for ducks, herons and other migratory birds."
