Understanding regulation of telecommunications infrastructure and the role cities and planners will have in regulating open access is becoming increasingly important. Cities will be asked to play an ever-increasing regulatory role: "At first, the Internet service providers tried to persuade local municipalities to use their cable franchising powers to require open access to high-speed cable services. Inevitably, these battles shifted to the courts, and not long ago a federal appellate court ruled that cable modem service is a "telecommunications service" that is more properly under the jurisdiction of the FCC."
